Terms and Conditions

These Terms and Conditions govern your use of Baltic Union Bank's banking services, website, mobile applications, and other related services.

1. Introduction

These Terms and Conditions ("Terms") govern your use of Baltic Union Bank's ("BUBC", "we", "us", or "our") banking services, website, mobile applications, and other related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Baltic Union Bank Sp. z o.o. is a digital banking platform registered in Poland with its principal office at ul. Marszałkowska 58, lokal 32, 00-545 Warsaw, Poland, operating under the supervision of the KNF (Komisja Nadzoru Finansowego).

Please read these Terms carefully before using our Services. If you do not agree with any part of these Terms, you should not use our Services.

2. Eligibility

2.1 Age Requirements

To be eligible to use our Services, you must be at least 16 years of age and possess a valid student ID card or national identification document. Customers between 16-18 years old may be subject to additional verification requirements and may have limited access to certain services.

2.2 Residency and Documentation

You must provide accurate, current, and complete information about yourself during the registration process, including:

  • Full legal name as registered in your country
  • Active email address
  • Mobile phone number connected to Telegram or WhatsApp
  • Valid identification documents
  • Proof of address
  • Date of birth
  • Country of origin
2.3 Right to Refuse Service

Baltic Union Bank reserves the right to refuse service, terminate accounts, or cancel transactions at our discretion, particularly if we believe you have violated these Terms or if we are unable to verify your identity or information.

3. Account Types and Fees

3.1 Account Types

Baltic Union Bank offers three types of accounts:

Initial account activation fee: $185
First-time withdrawal verification fee (for withdrawals ≥$1,000): $200
Account reactivation fee (after suspension): $500
3.3 Maintenance Fees

Baltic Union Bank does not charge monthly or annual maintenance fees for any account type.

4. Deposits and Withdrawals

4.1 Deposit Methods

We currently support deposits via:

  • Local bank transfers
  • USDT cryptocurrency transfers
  • PayPal
4.2 Withdrawal Methods

You can withdraw funds via:

  • Debit card
  • Local bank transfer
  • USDT address transfer
4.3 Withdrawal Requirements

For first-time withdrawals of $1,000 or more, you must pay a withdrawal code activation verification fee of $200. This fee activates your verified digital bank card and will be added back to your available balance once paid.

4.4 Transaction Processing
  • Deposits are typically processed within 3-5 minutes
  • Withdrawals are typically processed within 30 minutes
  • You must complete your first withdrawal transaction before proceeding with subsequent withdrawals

5. Account Security

5.1 Your Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • Ensuring all activities that occur under your account
  • Immediately notifying us of any unauthorized use or security breach
5.2 Account Suspension

Your account may be suspended if:

  • You enter an incorrect transaction PIN three times
  • We detect suspicious transaction patterns
  • We have reason to believe your account has been compromised
  • You violate these Terms
5.3 Account Reactivation

To reactivate a suspended account, you must:

  • Pay a reactivation fee of $500
  • Provide additional verification documents, including family card, national identity card, and valid passport with NFC capability

6. Prohibited Activities

6.1 Illegal Activities

You agree not to use our Services for any illegal purposes, including but not limited to:

  • Money laundering
  • Terrorist financing
  • Fraud or scams
  • Tax evasion
  • Purchase or sale of illegal goods or services
  • Circumvention of sanctions or embargoes
6.2 Account Abuse

You agree not to:

  • Attempt to gain unauthorized access to our systems or other user accounts
  • Use our Services in any manner that could damage, disable, or impair our platform
  • Provide false or misleading information
  • Create multiple accounts for deceptive purposes
  • Manipulate transaction values or details
  • Use VPNs, proxies, or other methods to disguise your location
  • Engage in any activity that violates the rights of others
6.3 Consequences of Violation

Violation of these prohibitions may result in:

  • Immediate termination of your account
  • Forfeiture of funds
  • Reporting to relevant authorities
  • Legal action

7. Termination and Account Closure

7.1 Closure by Customer

You may close your account at any time by contacting our customer support and completing any required verification procedures. Any remaining funds will be transferred according to our standard withdrawal process.

7.2 Termination by Baltic Union Bank

We reserve the right to terminate or suspend your account at our sole discretion, particularly in cases of:

  • Fraud or suspected fraudulent activity
  • Scams or participation in deceptive practices
  • Suspicious activities that violate our security protocols
  • Violation of these Terms or applicable laws
  • Regulatory requirements
  • Extended periods of inactivity
  • Providing false or misleading information
7.3 Evidence and Reporting

For accounts terminated due to fraud, scams, or suspicious activities, Baltic Union Bank will:

  • Document and preserve evidence of such activities
  • Cooperate with regulatory and law enforcement agencies as required by law
  • Share relevant information with the appropriate authorities
7.4 Effect of Termination

Upon termination:

  • You will no longer have access to your account
  • We may cancel any pending transactions
  • We may withhold funds if required by law or if there is suspicion of illegal activity

8. Intellectual Property

8.1 Ownership

All content on our website, mobile application, and Services, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Baltic Union Bank or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services for personal, non-commercial purposes, subject to these Terms.

8.3 Restrictions

You may not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information obtained from our Services
  • Use our trademarks, logos, or other proprietary information without our express written consent
  • Remove any copyright, trademark, or other proprietary notices from any content on our Services

9. Limitation of Liability

9.1 Service Availability

While we strive to provide uninterrupted Services, we do not guarantee that our Services will be available at all times. We will not be liable for any losses resulting from:

  • Scheduled maintenance
  • System failures
  • Network issues
  • Acts beyond our reasonable control
9.2 Limitation of Damages

To the maximum extent permitted by law, Baltic Union Bank shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from unauthorized access to your account
  • Damages resulting from your failure to comply with these Terms
  • Any loss or damage arising from your use or inability to use our Services
9.3 Maximum Liability

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have deposited in your account with us in the 6 months prior to the event giving rise to the liability.

10. Changes to Terms and Conditions

10.1 Updates to Terms

We may modify these Terms at any time at our sole discretion. Any changes will be effective upon posting the revised Terms on our website or mobile application.

10.2 Notification of Changes

We will notify you of any material changes to these Terms at least 30 days before they take effect through:

  • Email notifications to your registered email address
  • Prominent notices on our website or mobile application
  • In-app notifications
10.3 Continued Use

Your continued use of our Services after the effective date of any changes constitutes your acceptance of the revised Terms.

10.4 Disagreement with Changes

If you do not agree with the changes to these Terms, you must stop using our Services and close your account before the changes take effect.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

11.2 Initial Resolution

If you have any concerns or disputes regarding our Services, please contact our customer support first. We will attempt to resolve any issues informally.

11.3 Arbitration

If we cannot resolve the dispute informally, any controversy or claim arising out of or relating to these Terms or our Services shall be settled by binding arbitration in Warsaw, Poland, in accordance with the rules of the Polish Court of Arbitration at the Polish Chamber of Commerce.

11.4 Exceptions to Arbitration

The arbitration requirement does not apply to:

  • Actions to protect intellectual property rights
  • Claims for injunctive relief
  • Matters within the jurisdiction of small claims courts
11.5 Class Action Waiver

To the extent permitted by law, you agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class, consolidated, or representative action.

12. Refunds and Cancellations

12.1 Refund Policy

Due to the nature of our digital banking services, most fees are non-refundable once a service has been initiated. However, refunds may be considered in the following circumstances:

  • Services not rendered or significantly delayed due to our error
  • Duplicate charges for the same transaction
  • Unauthorized transactions (subject to investigation)
  • Technical errors resulting in incorrect processing
12.2 Refund Procedure

To request a refund, you must:

  • Contact our customer support within 30 days of the transaction
  • Provide transaction details and the reason for requesting a refund
  • Cooperate with any investigation we may conduct
12.3 Refund Processing

If approved, refunds will typically be processed within 7-14 business days. The refund will be issued using the same payment method used for the original transaction when possible.

12.4 Non-Refundable Items

The following fees are non-refundable under normal circumstances:

  • Account activation fees after your account has been activated
  • Withdrawal activation fees after the digital bank card has been generated
  • Account reactivation fees after your account has been reactivated

13. Communication

13.1 Electronic Communications

By using our Services, you consent to receive communications from us electronically, including emails, text messages, in-app notifications, and postings on our website or mobile application.

13.2 Contact Information

You are responsible for keeping your contact information current and accurate. Failure to maintain updated contact information may result in you not receiving important notifications about your account or changes to these Terms.

13.3 Recording Communications

We may record or monitor telephone calls and other communications between you and us for training, quality control, and compliance purposes.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Baltic Union Bank concerning your use of our Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure to perform our obligations where such failure is a result of acts of nature, government actions, or other forces beyond our control.
